Terms of use

We grant you the non-transferable, non-exclusive and revocable right to download and use the Epdetect Software free of charge, for your personal, non-commercial use only, subject to this licensing agreement.

Intellectual Property

You may not lease, rent or sell the Epdetect. Furthermore, you may not sublicense or otherwise transfer any right in the Epdetect Software. You agree not to modify, adapt, translate, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Epdetect Software. Distributing or creating derivative works based on the Epdetect Software is expressly not permitted.

Disclaimer of Warranties

The Epdetect Software is provided free of charge and with no warranties whatsoever, including but not limited to the reliability, utility or performance of the Epdetect software. We disclaim any responsibility for any harm resulting from the use of the Epdetect, it is the responsibility of the end user to establish the suitability of the Epdetect software for its intended use.

THE EPDETECT SOFTWARE IS PROVIDED AS IS WITH ALL FAULTS AND WITH NO WARRANTIES WHATSOEVER. WE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES THAT THE EPDETECT IS FREE OF DEFECTS, THAT IT IS MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE AND NON-INFRINGING.

YOU UNDERSTAND AND AGREE THAT YOU BEAR ENTIRE RISK AS TO THE FITNESS, THE QUALITY AND THE PERFORMANCE OF EPDETECT SOFTWARE AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY FAILURE TO PERFOM THE INTENDED TASK. IN SOME COUNTRIES THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES IS NOT ALLOWED, SO THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY RELATING TO THIS LICENSING AGREEMENT OR THE USE OF OR INABILITY TO USE THE EPDETECT SOFTWARE. IN SOME COUNTRIES THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES IS NOT ALLOWED, SO THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.

Other Terms

The present license agreement will be governed by and construed in accordance with the laws of England and shall not be governed by the United Nations Convention on the International Sale of Goods. The courts of England shall have exclusive jurisdiction.

If any part of this license agreement is held invalid or unenforceable, that part will be construed to reflect the parties original intent, and the remaining portions will remain in full force and effect.
